New Construction Exclusions for the Disabled

Construction completed after June 6, 1990 that make an existing dwelling more accessible to a severely and permanently disable person who is a permanent resident of the dwelling may be excluded from reappraisal.  The exclusion does not apply to accessibility improvements and features that are usual or customary for comparable properties not occupied by disabled persons.

Alternatively, when new construction is completed to an existing building for ADA compliance, a claim for reappraisal exclusion must be filed prior to, or within 30 days of, completion of construction.
